If your ex-husband or ex-wife has died
If your ex-husband, ex-wife, or former partner dies, you can get an Anw survivor benefit if:
- you met the conditions for receiving the benefit on the date of divorce as well as on the date of death, and
- your ex-husband or ex-wife was obliged to pay maintenance to you when he or she passed away. It makes no difference whether you actually received the maintenance.
If you received maintenance from your ex-husband or ex-wife
If you received maintenance from your ex-husband or ex-wife, the amount of your Anw benefit cannot be higher than the amount that your ex-husband or ex-wife was obliged to pay you. If the maintenance payable was higher than the maximum Anw benefit, you can receive no more than the maximum amount of Anw benefit.
Any other income you have can be deducted from your Anw survivor benefit.
