Accidents at work and occupational illnesses in Belgium
If you become unable to work due to an accident at work or while travelling to or from work, or if you are suffering from a recognized occupational illness, you can get an incapacity benefit. In the case of an accident, your employer's insurance company will pay the benefit. If you have an occupational illness, the benefit will be paid to you by the Occupational Illnesses Fund. You can also get reimbursement for medical care.
If you pass away as a result of the accident or illness, your partner and children can get a benefit.
Amount and duration of the benefit
The amount of your benefit depends on your situation and your wages in the year prior to your illness. If you are temporarily incapacitated for work, you can get 90% of your wages (90% of wages up to a maximum of € 36,809.73 per year). If you are still working part-time, your wages will be topped up to 100%.
You will keep the benefit as long as you are ill and unable to work. When you retire, the benefit will normally be reduced.
Benefit amount in the case of permanent incapacity
| Degree of incapacity | Benefit |
|---|---|
| Less than 5% | 50% of the degree of incapacity x the wages (up to € 36,809.73) |
